Wappy Terms of Use

1. Service and agreement
Wappy provides forms, responses, products, services, bookings, workspaces, teams, and Telegram functions. Wappy is provided by Andrey Aleksandrovich Litvinov, an individual. Contact email: litvinov.andreiy@proton.me. Postal address for legally significant notices: 296100, Dzhankoy, Oktyabrskaya St., 93. Creating an account and checking the required box forms the agreement. The Privacy Policy is provided for information and is not accepted instead of separate consent.
Legal details contain the same provider and personal-data controller information used by these documents.
2. Age and account
Account holders and team members must be at least 18 and have capacity to enter the agreement. Users must provide accurate information, protect email, Telegram, and sessions, and report compromise.
3. Workspaces and forms
The Workspace Owner manages access. The Form Owner determines the purpose, fields, legal ground, retention, notice or consent text, and later use of responses. The Form Owner must disclose these details before submission and avoid excessive or restricted data.
4. Restricted data
Users must not intentionally collect through forms data of people under 18, special categories, medical or intimate-life information, political or religious beliefs, biometric identification data, identity-document copies, payment-card data, passwords, tokens, keys, or other secrets. Free-text fields must not bypass this rule. An ordinary display photo is allowed but is not used for face recognition.
5. Public profiles
Public profiles and indexing are disabled by default. A member's data is published only with that member's own separate permission; a Workspace Owner cannot consent for another member. Permission may be withdrawn without account deletion.
6. Content and third-party services
Rights in uploaded content remain with the rights holder. The user grants Wappy a limited right to host and display it only for selected functions and confirms grounds for third-party data. Telegram, email providers, and future WhatsApp functionality, if launched, may have their own terms and involve international processing; Wappy does not claim that WhatsApp processing is currently active.
7. Changes and termination
Wappy may change features, perform maintenance, and restrict access for breach, security, or legal requirements. Material changes are published as a new version and require renewed explicit acceptance where these Terms or applicable law require it. A user may delete an account, but a Form Owner's obligations to respondents survive.
Prohibited Use and User Responsibility
- Users must use Wappy lawfully, in good faith, and in accordance with these Terms.
- The Workspace Owner is responsible for activities performed on behalf of the workspace, including actions of invited team members within their granted access.
- The Workspace Owner is independently responsible for:
- the lawful purposes of forms and subsequent data processing;
- the content of forms, fields, messages, public pages, products, services, and materials;
- obtaining all required lawful grounds, consents, permissions, and notices;
- the accuracy of information provided to respondents and customers;
- lawful use of Telegram, future WhatsApp functionality if launched, email, and other integrations;
- respecting third-party rights, including rights relating to personal data, images, trademarks, copyrighted works, and other protected information;
- subsequent use, export, and disclosure of data obtained through Wappy.
- Wappy must not be used to:
- violate applicable law or third-party rights;
- commit fraud, mislead others, or impersonate another person or workspace;
- unlawfully collect, publish, sell, or disclose personal data;
- send spam or messages without a required lawful basis;
- collect data prohibited by these Terms or a separate Restricted Data Policy;
- distribute malicious code, conduct phishing, gain unauthorized access, or disrupt the service;
- publish illegal content or organize illegal activities;
- circumvent Wappy's technical restrictions, plan limits, or security measures.
- Wappy does not independently determine the purposes or content of user-created forms, products, services, or communications and does not become a party to relationships between the Workspace Owner and its respondents, customers, or counterparties merely by providing the technical platform.
- Wappy is not responsible for unlawful acts of a user, Workspace Owner, or team member, or acts performed in breach of these Terms or third-party rights, or for the consequences of those acts, except where Wappy's liability is required by law or arises from Wappy's own acts or omissions.
- Nothing in this section excludes or limits Wappy's liability for:
- Wappy's own intentional breach;
- Wappy's duties as an independent personal data controller;
- Wappy's duties as a processor acting on documented instructions, to the extent required by law and contract;
- mandatory consumer rights;
- any other liability that cannot lawfully be excluded or limited.
- Where there are reasonable indications of a violation, Wappy may request an explanation, restrict access to specific content or functions, suspend a form or workspace, remove illegal content, or terminate the agreement in accordance with these Terms and applicable law.
- Wappy is not required to review every user-created form, publication, product, service, or message in advance. A complaint or indication of a possible violation does not automatically establish wrongdoing; Wappy may perform a reasonable review and request additional information.
- If a user's violation results in a claim against Wappy by a third party or public authority, the user must reasonably cooperate and provide relevant information. Any duty to reimburse Wappy for documented losses applies only to the extent permitted by law and does not restrict mandatory consumer rights.
9. Liability and law
The Form Owner is responsible for the lawfulness of purposes, fields, legal ground, wording, retention, and subsequent use. A generic template is not professional advice. Russian law applies unless mandatory rules require otherwise.
